Terms of Service

By downloading, installing, or using the ProteGuard application, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles.

ProteGuard is a sensor-based personal safety application owned and operated by TRUEic LLC, an Ohio limited liability company.

ProteGuard provides automated safety alerts and sensor-based detection to assist users in emergency situations. By using this service, you acknowledge and agree to the following:

• ProteGuard provides automated safety alerts but cannot guarantee prevention of harm, injury, or death.
• The app is a supplemental safety tool and is not a substitute for calling emergency services (such as 911 or local emergency numbers).
• ProteGuard is not a medical device and does not provide medical advice, diagnosis, or treatment.
• ProteGuard is not a professional emergency service and does not employ emergency responders.

By using ProteGuard, you agree to:

• Provide accurate emergency contact information. TRUEic LLC is not responsible for failed alerts caused by incorrect or outdated contact information.
• Use the app in compliance with all applicable local, state, and federal laws.
• Not use the app to transmit false emergency alerts or to harass, threaten, or harm others.
• Grant the necessary device permissions (location, motion, microphone) required for the app to function properly.
• Keep your emergency contact information current and accurate.

To the fullest extent permitted by applicable law, TRUEic LLC shall not be liable for:

• Missed, delayed, or failed alerts caused by network outages, device malfunctions, sensor inaccuracies, or incorrect user configuration.
• Any harm, injury, loss, or damage resulting from reliance on the app's safety features.
• Sensor inaccuracies or false positives/negatives in safety detection.
• The failure of emergency contacts to receive, read, or respond to alerts.
• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the app.

ProteGuard is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. TRUEic LLC does not warrant that the app will be uninterrupted, error-free, or free of harmful components.

ProteGuard™ and all related branding, logos, product names, and proprietary technology are the exclusive property of TRUEic LLC. Nothing in these Terms grants you any right to use TRUEic LLC's trademarks, trade names, service marks, or other proprietary designations.

All rights not expressly granted herein are reserved by TRUEic LLC.

TRUEic LLC reserves the right to modify, suspend, or discontinue ProteGuard (or any part thereof) at any time, with or without notice. TRUEic LLC shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

TRUEic LLC may update these Terms of Service from time to time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of ProteGuard after changes become effective constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio. Any disputes arising out of or relating to these Terms or the use of ProteGuard shall be resolved in the state or federal courts located in Hamilton County, Ohio, and you consent to the exclusive jurisdiction of those courts.
